| 7. (1) Directors - The Minister may appoint members of the Service to be known as Directors of Divisions and Regional Directors. | ||

| 8. (1) Other members - The Commissioner, under the direction of the Minister, may appoint such other members of the Service as are necessary for the administration of this Act, and, in respect of those appointments, the preferences provided in the Public Service Employment Act in respect of military service apply. | ||

Ranks and grades - The ranks and grades of members appointed by the Commissioner under subsection (1), the maximum number of persons to be appointed to each of those ranks and grades and their salaries shall be as prescribed by the Treasury Board. [RSC 1970 cP-6 s6; AS 1985 c35 s18] |

| 9. (1) Oath - Every member of the Service shall, before entering on the duties of his office, take the oath of allegiance and, in the case of a member, an oath of office in the following form: | ||
| I,……, solemnly swear that I will faithfully, diligently and impartially execute and perform the duties required of me as a member of the Correctional Service of Canada and will well and truly obey and perform all lawful orders that I receive as such, without fear, favour or affection of or toward any person. So help me God. | ||
| (2)
Authority to administer - The oath prescribed by subsection (1) and any other oath or declaration that may be necessary or required may be taken by the Commissioner before any judge, provincial court judge or justice of the peace having jurisdiction in any part of Canada, and by any other member of the Service before the Commissioner or any officer in charge of an institution or any person having authority to administer oaths or take or receive affidavits. | 10. (1) Tenure - Members of the Service hold office during pleasure | ||
| (2) Suspension - The Commissioner may, where the Commissioner considers it in the interests of the Service, suspend from duty any member of the Service. | ||
| (3)
Idem - The member in charge of a penitentiary may, where that member considers it in the interests of the Service, suspend from duty any member of the Service who is under his jurisdiction. [RSC 1970 cP-6 s8; RSC 1985 c35 (2nd Supp) s18] |

| 11.
When Commissioner and Deputy Commissioner absent - In the event that the Commissioner and Deputy Commissioner are absent or unable to act or their offices are vacant, the senior Divisional Head at the headquarters of the Service has the control and management of the Service and all matters connected therewith, and for those purposes the senior Division Head may exercise all the powers of the Commissioner under this Act or any other Act of Parliament. Peace officer - The Commissioner may, in writing designate any member of the Service or each member of a class of members of the Service to be a peace officer and a member so designated is a peace officer in every part of Canada and has all the powers, authority, protection and privileges that a peace officer has by law.
