Employment of Inmates

35. (1) Every inmate is required to work in a position at an occupation or activity that is calculated to assist in his reformation and rehabilitation. [SOR/84-392]
    (1.1) An inmate who refuses to work, fails to work to the best of his ability, or leaves his work without the permission of a member, may [SOR/88-547]
 (a)
be suspended from his position by an officer at the level of Assistant Institutional Head or higher who is authorized to do so under the directives; and
 (b)
be excluded from any position for a period not more than 6 weeks in accordance with the directives on the decision of the Inmate Employment Board provided for in the directives.

    (1.2) Notwithstanding subsection (1.1), the head of the institution may reduce or cancel the exclusion period referred to therein where, taking into account all the circumstances of the case, he considers it reasonable to do so on humanitarian or rehabilitative grounds and the inmate indicates his willingness to work.

    (2) Saturdays, Sundays and statutory holidays are non-working days for inmates, except those inmates who occupy a position designated essential in accordance with a directive.

    (3) No inmate shall be required to work for the personal benefit of any private person.
    (4) No inmate shall be employed in a disciplinary capacity over another inmate.
    (5) Where an inmate alleges that he is not physically fit to perform the work to which he has been assigned, he shall not be employed at that work; unless the physician certifies that he is physically fit to perform it.
