Voting

36. (1) The minimum number of members of a provincial parole board who must vote before parole may be granted or denied is two.
    (2) Nothing in subsection (1) prohibits a province, by an act of its legislature, by regulation or by an order of the chairman of its provincial parole board, from directing that any number of members of the board greater than the minimum number prescribed by that subsection shall consider a case and vote.

37. (1) The minimum number of affirmative votes by members of a provincial parole board required to grant or deny parole in accordance with subsection 36(1) is a unanimity of votes.
    (2) Where there is no unanimity of votes as required by subsection (1), the chairman of the provincial board shall assign an additional member of the board to cast a vote and thereupon the decision shall be effected by a majority vote.
    (3) The minimum number of affirmative votes required to grant or deny parole in accordance with subsection 36(2) is a majority of the number of members voting.
