Subject to sections 6, 8 and 11.1, the portion of the term of imprisonment that an inmate must serve before full parole may be granted is one-third of the term of imprisonment imposed on the inmate or seven years, whichever is the lesser.

The portion of the term of imprisonment that an inmate sentenced to imprisonment for life, otherwise than as a minimum punishment, must serve before full parole may be granted is seven years, minus any time spent in custody between the day on which the inmate was arrested and taken into custody in respect of the offence for which the inmate was so sentenced and the day on which the sentence was imposed. The portion of the term of imprisonment that an inmate in respect of whom a sentence of death was commuted to imprisonment for life before January 1, 1974, must serve before full parole may be granted is ten years minus any time spent in custody between the day on which the inmate was arrested and taken into custody in respect of the offence for which he was sentenced to death and the day the sentence was commuted to a sentence of imprisonment for life. | ||
