| The applicant, A, sought an order setting aside a decision made by the Commissioner to transfer him from a medium to a maximum-security penitentiary. A argued that he was not provided with sufficient information to properly respond to the allegations made against him. While A was given a Progress Summary Report outlining four specific reasons for his transfer recommendation and two memos providing him with the ‘gist’ of a Security Intelligence Report setting out further details of the alleged transgressions, he nevertheless was not provided with the exact identity of the source of some of the allegations. Rouleau J. held that withholding the identity of the informants, as well as the details of their statements that would in all likelihood identify the source, was justified. The applicant was given enough information and knew the case he had to meet. |
